GCSO Statement Regarding Meeting with Immigrant Rights Organizations and Sheriff Rogers' Position on Immigration in Guilford County

Sheriff Rogers has met with several groups regarding immigration both formally and informally. He has issued statements regarding his position on immigration matched with that of public safety. Some members representing the immigrant community have asked the Sheriff to tailor his license check points around the time children are released from school. The concern expressed is immigrant parents driving without a license fear being subject to arrest while attempting to pick up their child(ren) from school resulting in ICE notification.

Sheriff Rogers understands there are deportation concerns from the immigrant community and he sympathizes with the challenges faced in gaining citizenship. He also understands, he has a job to do to keep all citizens safe and that does not include telling officers to stop doing their jobs at certain times of the day because law breakers (e.g. driving without a license) may be on the road. The Sheriff expressed he will not waiver on this matter which to some has been interpreted as defensive and uninviting.

Sheriff Rogers and the Guilford County Sheriff Office Attorneys made it clear that he must follow the law citing Federal and State Statutes:

  • Fed. 8 U.S. Code § 1373-Communication Between Government Agencies and Immigration and National Service
  • N.C.G.S. § 153A-145.5-Adoption of Sanctuary Ordinance Prohibited
  • N.C.G.S. § 162-62-Legal Status of Prisoners

Sheriff Rogers and the Guilford County Sheriff's Office Attorneys also made clear his position on immigration spelled out in four key points:

  1. Guilford County Sheriff’s Office ended its involvement in the 287(g) program in 2012 and Sheriff Rogers will not renew the program under his watch.
  2. Guilford County Sheriff's Office will NOT enforce the 48 hour hold provision in ICE Detainers after an inmate's State criminal charges have been resolved.  The only exception will be when ICE presents an actual warrant or order issued by a Federal judicial official (i.e., a Federal Judge or Federal Magistrate).
  3. Guilford County Sheriff's Office opposes HB 370 as presently drafted by the General Assembly.
  4. Guilford County Sheriff's Office is going to begin accepting Faith Action ID cards for identification purposes. GCSO is currently in the process of finalizing it's agreement with Faith Action. Most important, Sheriff Rogers will not participate in any acts that could be perceived as racial profiling and he vows to protect and serve all communities equitably. We look forward to your continued support.
